Terms of Service for AtomGigs

1. Acceptance of Terms

By accessing or using atomgigs.com ("Platform"), you agree to comply with and be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Platform.

2. Changes to Terms

We may update these Terms at any time without prior notice. Continued use of the Platform constitutes your acceptance of the updated Terms.

3. Description of Services

AtomGigs provides a platform where users can:

• Employers: Post tasks and pay workers for completed work.
• Workers: Complete tasks and earn money.

4. Account Registration

To use our Platform, you must:

• Be at least 18 years old or the legal age in your country.
• Provide accurate and complete information during registration.
• Maintain the confidentiality of your account credentials.
• Notify us immediately of any unauthorized use of your account.

5. User Responsibilities

You agree to:

• Use the Platform lawfully and ethically.
• Not engage in fraudulent, misleading, or deceptive activities.
• Not post or share any content that is offensive, defamatory, or violates any laws.
• Respect the intellectual property rights of others.

6. Posting and Completing Tasks

• Employers are responsible for clearly describing tasks, setting fair compensation, and verifying completed work.
• Workers are responsible for completing tasks as described and submitting valid proof of completion.
• AtomGigs is not responsible for disputes between Employers and Workers but may mediate at its discretion.

7. Payments and Fees

• Payments are processed through third-party payment gateways.
• AtomGigs charges a fee for transactions to cover operational costs.
• Users are responsible for any applicable taxes related to earnings or payments.

8. Withdrawal Policy

• 1. No Payment for Declined Tasks

     • If a user gets 3 tasks declined, they will not receive payment for any pending tasks unless they are approved.

  2. Inactive Account Withdrawal Restriction

     • Accounts that remain inactive (no task activity) for over 1 year will lose access to previous earnings. Withdrawals will not be allowed after this period.

  3. Same IP Address Policy

     • No withdrawals will be processed for accounts using the same IP address as other users.

     • This is to prevent multiple accounts and protect employer trust.

  4. Rating-Based Restriction

     • If a worker’s rating falls below 3.0, withdrawal will be disabled until they improve their performance and rating.

  5. Device & Location Policy

     • If a single account is accessed from multiple devices or locations (e.g., phone + laptop, or different cities/countries), withdrawals will be blocked for account verification.

  6. Unauthorized Bonus Transfers

     • Do not send bonuses to any employer or worker without prior approval from the AtomGigs team.

     • Unauthorized bonus transfers may lead to account suspension or funds being frozen.

     • BEN Form Approval Requirement

       • If a user requests withdrawal without waiting for BEN form approval, their account will be flagged, and withdrawals will be permanently disabled for that account.

  Important Notes

  • These rules are strictly enforced.

  • Violating any of the above may result in temporary or permanent suspension.

  • Our goal is to protect honest users and ensure the safety of employer funds.

• Minimum withdrawal thresholds apply.
• Withdrawals are subject to verification and processing times.
• AtomGigs is not liable for delays caused by third-party payment providers.
• If a user receives 3 task rejections within a 3-month period, their account will be flagged, and they will be permanently disqualified from making withdrawals.

9. Prohibited Activities

You agree not to:

• Use the Platform for illegal or unauthorized purposes.
• Attempt to hack, spam, or otherwise disrupt the Platform's operations.
• Impersonate any person or entity or misrepresent your affiliation.

10. Intellectual Property

All content on AtomGigs, including logos, text, graphics, and software, is the property of AtomGigs or its licensors. You may not reproduce, distribute, or create derivative works without prior written consent.

11. Disclaimer of Warranties

The Platform is provided "as is" without any warranties of any kind. AtomGigs does not guarantee that:

• The Platform will be error-free, secure, or uninterrupted.
• Tasks or payments will be completed or honored.
• User-generated content will be accurate or reliable.

12. Limitation of Liability

To the fullest extent permitted by law, AtomGigs shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from:

• Use or inability to use the Platform.
• Unauthorized access to your account.
• Any interactions or disputes between Users.

13. Indemnification

You agree to indemnify and hold AtomGigs harmless from any claims, losses, damages, or expenses arising out of:

• Your use of the Platform.
• Your violation of these Terms.
• Your violation of any rights of another party.

14. Termination of Account

We reserve the right to suspend or terminate your account at our discretion, including but not limited to violations of these Terms or suspicious activity.

15. Governing Law

These Terms are governed by the laws of [Your Country], without regard to its conflict of law principles.

16. Dispute Resolution

Any disputes arising from these Terms or your use of the Platform shall be resolved through negotiation, mediation, or arbitration, as deemed appropriate by AtomGigs.
